The Copyright Royalty Board May be Unconstitutional July 8, 2009
The fine folks at the The Volokh Conspiracy have posted an interesting opinion released recently.
A judge on the D.C. Circuit Court of Appeals wrote separately from the other judges to express his concern that the members of the Copyright Royalty Board are appointed unconstitutionally. The Board decides on reasonable royalties for use of copyrighted songs. Hit up the link to read the judge’s argument. It’s only about three paragraphs long.
